**UPDATE - See attached SF 30 for Amendment I.** This solicitation is issued under the authority of FAR 6.302-1(c) Brand Name. All offerors may submit a proposal which shall be considered by the agency. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Availability of Funds - Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. This is a request for proposal (RFP). This solicitation documentation and incorporated provisions and clauses are those in effect through Federal Aquisition Circular 2005-61. The Centers for Medicaid & Medicare (CMS) is seeking proposals for a firm fixed price contract to provide maintenance support for the Government's existing inventory of SAP BusinessObjects software and licenses. The anticipated award date is on or before December 12, 2012. Your proposal shall include pricing for a base period and one 12-month option period. For informational purposes, previous ordering information has been included in the requirements listed in the line items in the attached SF 1449. This RFP does not commit the Government to pay any cost for the preparation or submission of this proposal. In addition, the Contracting Officer is the only individual who can legally commit the Government to the expenditures of public funds in connection with the proposed procurement.
