The Small Business Administration (SBA) has updated the size standards for 13 industries within the NAICS Sector 22, Utilities, effective January 22, 2014. Notably, the SBA increased receipts-based size standards for three industries and shifted the measurement basis for ten electric power generation, transmission, and distribution industries from megawatt hours to the number of employees. Additionally, SBA removed a prior footnote that limited small business status based on electric output, thereby eliminating the previous 4 million megawatt hours cap. Other industries in Sector 22 retain their existing size standards. This revision results from a comprehensive review aimed at refining size standards to better reflect current industry conditions, thereby expanding eligibility for SBA's loan and federal procurement programs to approximately 400 more firms. These changes improve access for small businesses in the utilities sector by recalibrating benchmarks that define business size, making it easier for more firms to qualify as small businesses under SBA guidelines. Detailed information and comments on the final rule, along with previous proposals, can be accessed via SBA’s regulations website. For further inquiries, Carl J Jordan is the designated contact, reachable by phone or email. This adjustment supports SBA's ongoing efforts to foster small business growth and participation in federal contracting within the utilities domain.

The United States Small Business Administration (SBA) has revised the size standards for 13 industries in NAICS Sector 22, Utilities. Specifically, SBA - increased receipts based size standards for three industries; - changed the basis for measuring business size from megawatt hours to number of employees for the 10 electric power generation, transmission, and distribution industries; and, - removed Footnote 1 from SBA's Table of Size Standards that applied to all of the NAICS codes in electric power generation, transmission, and distribution. Before its removal, the footnote stated that a firm is small if, including its affiliates, it is primarily engaged in the generation, transmission, and/or distribution of electric energy for sale and its total electric output for the preceding fiscal year did not exceed 4 million megawatt hours. This requirement no longer applies. SBA is retaining the current size standards for the remaining industries in Sector 22. As part of its ongoing comprehensive size standards review, SBA evaluated all size standards for industries in NAICS Sector 22 to determine whether they should be retained or revised. Approximately 400 additional firms will be small under the new size standards and eligible for SBA's loan and Federal procurement programs. You may read/download SBA's final rule at www.regulations.gov (search on "RIN 3245-AG25" [without quotes]). You may also review the originally proposed rule together with all of the comments submitted by going to www.regulations.gov. The proposed rule and the comments are included in the same docket. The revised size standards are effective January 22, 2014.

Administrative Lease Authorization and Regulatory Compliance SupportThe California State Lands Commission is authorizing an administrative lease for a 20-year general lease agreement to support public agency use of an existing pedestrian bridge that crosses sovereign lands. This action involves formalizing the long-term operational use of the structure while ensuring compliance with state regulatory frameworks, including a determination of eligibility for a CEQA categorical exemption to avoid full environmental review. The lease pertains specifically to infrastructure already in place and is intended to provide legal clarity and continuity for public access purposes without requiring new construction or substantial modification. The activity falls under NAICS code 926110, indicating it is a government administration function related to land and natural resource management. The project is centered in Red Bluff and is part of a broader effort to maintain public infrastructure on state-held lands while streamlining regulatory processes through established exemptions. The administrative action requires internal review and documentation to confirm that the lease meets statutory criteria for categorical exemption under CEQA, ensuring no significant environmental impact from continued use. No new solicitation or competitive bidding is involved, as the lease supports an existing facility under the jurisdiction of the California State Lands Commission. The contract serves as a procedural and regulatory support mechanism to sustain public access and uphold compliance with state land management policies over the 20-year term.
