The 437th Contracting Squadron at Charleston Air Force Base intends to award a sole source contract to American Science and Engineering, Inc. for an all-inclusive service and maintenance agreement for the Z-Portal Cargo and Vehicle Screening System. This action is being taken under the authority of FAR 6.302-1, as American Science and Engineering designed and built the proprietary Z Backscatter Portal and holds the copyright to its operating software. The system is critical for electronically X-raying vehicles and cargo entering the base while maintaining radiation safety standards, and the government has determined that no other source can satisfy these specific requirements. While this notice is not a request for competitive proposals, interested parties were permitted to submit capabilities or proposals for consideration by February 24, 2010. The contract requires strict adherence to various Federal Acquisition Regulation and Defense Federal Acquisition Regulation Supplement clauses, including requirements for Central Contractor Registration and Wide Area Work Flow. The award is intended to be made in the aggregate to ensure the continued operational readiness of the screening system and the overall security mission of the installation.

NOTICE OF INTENT TO AWARD SOLE SOURCE THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Reference Number is F1M3F10043A001ZPortal. The 437th Contracting Squadron, 101 E. Hill Blvd., Charleston AFB SC, requires all inclusive service and maintenance agreement for the Z-Portal Cargo and Vehicle Screening System located at Charleston AFB, South Carolina. The 437th Contracting Squadron intends to make an award to American Science and Engineering, Inc., 826 Middlesex Turnpike, BILLERICA, MA 01821. Market research was performed and information gathered in determining this company to be the only source for this requirement in the US. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested parties may identify their interest and capability to response to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received by the appointed due date will be considered by the Government. If the equipment was to breakdown and they were not at our disposal, it would adversely affect the mission. Award shall be made in the aggregate all or none.
