The U.S. Department of Energy’s Office of Nuclear Safety plans to issue a sole source contract to Doxcelerate for continued software licenses and renewal of maintenance agreements for the RevCom software used in the Technical Standards Program. This contract covers software licenses, ongoing maintenance, technical consultation, unscheduled upgrades, and periodic technical updates. The RevCom software was specifically developed by Doxcelerate for the DOE’s Directive System and Technical Standards Program, with proprietary rights to the source code held exclusively by Doxcelerate. As such, Doxcelerate is the only provider capable of supplying these software products and related services, which are crucial to maintaining uninterrupted operations of the DOE Directive System without incurring significant additional costs or availability issues. The DOE is pursuing this sole source contract under the exemption to full and open competition, citing that Doxcelerate is the only responsible source for this requirement. This notice of intent is not a solicitation for competitive proposals. However, other firms believing they can fulfill the requirement are invited to submit capability statements and pricing information by a specified deadline, after which the DOE will determine whether to compete the contract. This decision will be made solely at the DOE’s discretion, based on the responses received. The contract intends to address the essential need for ongoing support and maintenance of the proprietary software critical to the agency’s operations.

Full Description

The U.S. Department of Energy (DOE), Office of Nuclear Safety (HS-30), intends to award a sole source contract to Doxcelerate by means other than the use of full and open competition to continued software licenses and a renewal of existing maintenance agreements for RevCom for Technical Standards Program (TSP). Associated supplies and services include software licenses, maintenance, the availability of technical consultation in the event of uncertainty or product malfunction, unscheduled periodic upgrades of the software as they are released, and periodic technical bulletins as new information becomes available. Doxcelerate designed the required software programs specifically for use of DOE?s Directive System and Technical Standards Program. Doxcelerate as the creator of the software has proprietary rights to the source code. These proprietary software products are only available from Doxcelerate. This support is essential to continued operation of the DOE Directives System without significant cost and availability impacts. The DOE is using exemption to competition 6.302-1(a) (2) (ii), One Responsible source. This is a notice of intent and not a request for competitive proposals. No solicitation is available for this requirement. If a firm believes the DOE should not pursue this sole source contract with Doxcelerate, then they should submit a capability statement and pricing information for the requirement by June 19, 2014 at Noon (Eastern Time) via e-mail to contact@example.gov. The written response must include a general statement for the services mentioned in this announcement. A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
