The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. The Bureau of Alcohol, Tobacco, Firearms and Explosives intends to award a sole source firm fixed price contract to PenLink LTD, 5936 VanDervoor Drive, Lincoln, NE 68516-2305 for the purchase of Telecommunication Analysis software, software maintenance services, as well as, telephone, and internet help desk support. PenLink LTD. is the original developer, the designer, and the sole owner of all patents and trade secrets in regards to this requirement. The North American Industry Classification System (NAICS) Code is 511210 with a size standard of $25 million dollars. Any award resulting from this requirement will be issued pursuant to FAR Part12, Acquisition of Commercial Items-FAC 2005-30 effective January 31, 2009. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED.
