Sole Source Procurement for Athene VMware

J & A 6.302-1(a) The is a notification that the Internal Revenue Service (IRS) intends to award on a sole source basis to NetFusion a purchase order for brand name Athene VMware software and maintenance. The statutory authority permitting other than full and open competition is Section 303(c) of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act [41 U.S.C. 253(c) (1)], implemented under FAR 6.302-1(a), which authorizes other than full and open competition when there is only one responsible source and no other supplies or services will satisfy agency requirements. The award will be issued on a sole source basis to NetFusion, Inc. 2610 Goldmine Road, Brookville, MD 20833 under the authority of FAR 6.302-1 for proprietary Athene VMware software and maintenance. The IRS is requesting Athene Software Control Center Licenses and Maintenance for Tier 2 architecture capacity and performance studies. NetFusion's Athene VMware Software is the only comprehensive performance management product that delivers the entire spectrum of data collection, data warehousing, performance alerting, performance analysis, modeling, capacity planning, and detailed long term statistical analysis as is required by the IRS. NetFusion's Athene VMware software is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. The period of performance is one year. Based on the above, the justification is certified as complete and accurate by the technical requirements personnel to the best of the technical personnel and the Contracting Officer's knowledge and belief. In response to this notice, all responsible sources may submit a Capability Statement which shall be considered by the agency.
