The Cherokee Nation Housing Authority is soliciting bids for the rehabilitation of a single home in Delaware County, Oklahoma, with work required to be completed within 21 working days after issuance of the Notice to Proceed. Bids must be submitted by June 9, 2026, and bidders are required to fully complete the Mandatory Bid Response sheet and Work Write-Up to be considered responsive and responsible. Preference is given to bidders certified by the Cherokee Nation’s Tribal Employment Rights Office (TERO), and proof of certification must accompany the submission. Successful contractors must comply with all Tribal rules and regulations, including TERO requirements, and adhere to federal labor standards under the Davis-Bacon Act, the Copeland Act, and the Contract Work Hours and Safety Standards Act, including submission of certified payrolls and payment of prevailing wages. The contract includes stringent bonding requirements: a 5% bid guarantee and a performance and payment bond equal to 100% of the contract price, acceptable in the form of a surety bond, irrevocable letter of credit, or cash escrow. Bidders must also complete Form HUD-5369-A for representations and certifications, including affirmations regarding small business status, minority or women-owned status, Indian-owned enterprise certification, and non-collusive bidding, along with Form HUD-2530 for previous participation. The work must meet energy efficiency standards under the Energy Policy and Conservation Act and comply with EPA guidelines for recovered materials and HUD Section 3 requirements promoting economic opportunity for low-income residents. Inspection and acceptance occur on-site by a designated HACN representative, with final approval contingent upon full compliance with all regulatory and contractual obligations. Late performance incurs liquidated damages of $100 per working day beyond the 21-day deadline. The government retains audit rights to records for three years post-completion and may debar or suspend noncompliant contractors. Subcontractors are bound by the same labor and compliance obligations as the prime contractor. No contract value is specified, and while electronic submission via email is permitted, physical sealed bids are the default method.
