AI Contract Overview
The contract pertains to the procurement of two pulse transformers, identified by NSN 5950-01-188-6167, under an indefinite-delivery contract issued by the Defense Logistics Agency through solicitation SPE7M1-26-U-4573. Delivery is required 71 days after order acceptance, with FOB Destination terms placing full cost and risk responsibility on the contractor until delivery at the designated destination. The contract is structured as a total small business set-aside under NAICS code 334416, with awards based on trade-off evaluation, considering price and other factors rather than lowest price technically acceptable. Compliance with stringent DLA packaging and preservation standards, specifically MIL-STD-2073-1E and MIL-STD-129, is mandated, including specific packaging codes, preservation methods, and GS1-128 barcoding for shipment identification. Marking and labeling must adhere to federal hazardous materials regulations, including 29 CFR 1910.1200, and all documentation must be submitted electronically via Wide Area WorkFlow. The item is subject to export control under ITAR or EAR, restricting disclosure of technical data to foreign persons, and only contractors with approved JCP certification, completed DLA training, and formal authorization may access such data. Cybersecurity requirements under 252.204-7012 mandate safeguarding covered defense information and reporting cyber incidents, while additional clauses prohibit the use of hexavalent chromium, restricted telecommunications equipment, and mandate whistleblower rights notification and employment eligibility verification. Invoicing and payment are governed by DoDAACs and WAWF, with no fixed pricing listed in the solicitation, though the maximum contract value is capped at $350,000. The contract includes numerous DFARS and FAR clauses addressing sustainable products, trafficking in persons, hazardous materials handling, cybersecurity, subcontracting, and compensation restrictions for former DoD officials. All proposals must be submitted electronically through DIBBS by August 6, 2026, and offerors must provide valid UEI and CAGE codes, represent small business status, and comply with all applicable representations and certifications, including those related to joint ventures and non-manufacturer status.
