The Consumer Financial Protection Bureau (CFPB) issued a contract for the procurement of a software-as-a-service solution designed to efficiently analyze demographic data and MD-715 tables for potential equal employment opportunity (EEO) barriers related to sex, race, national origin, and disability. This tool is intended to help the Bureau’s Office of Civil Rights within the Office of Equal Opportunity and Fairness identify triggers that may indicate EEO concerns. The contract is a firm fixed price arrangement valued at $301,995 and was awarded without full and open competition under the statutory authority that recognizes there is only one responsible source capable of meeting the agency's specific requirements. Extensive market research was conducted, including outreach to other federal agencies and internet searches, which confirmed that no similar commercial or government-off-the-shelf software exists to perform these specialized analyses. Larger agencies typically develop in-house solutions requiring specialized statistical and data expertise, which CFPB lacks. A public notice on Federal Business Opportunities was issued, but no other interested vendors responded. The contract officer has ensured that pricing is fair and reasonable through price analysis without requiring full cost data. CFPB intends to monitor the market going forward and revise its approach if alternative sources become available to encourage broader competition in any future procurements.
