The device must meet FDA classification 868.5925 and hold valid 510(k) clearance, and the contractor is responsible for ensuring the product is free from hazardous materials, compliant with hazard communication standards, and properly marked with the NSN and unit of issue (EA). All deliveries are acceptance-tested at destination, per FAR 52.246-2, and payment must be requested electronically through Wide Area WorkFlow with no manual invoicing permitted. The contract is subject to extensive compliance with Federal Acquisition Regulation and Defense Federal Acquisition Regulation Supplement clauses, including cybersecurity safeguards under FAR 52.240-93 and DFARS 252.204-7012, requiring adherence to NIST SP 800-171 for safeguarding covered defense information and reporting cyber incidents. Contractors must affirm compliance with employment non-discrimination clauses, combating human trafficking requirements, employment eligibility verification, and prohibitions on mandatory arbitration agreements for sexual harassment claims.
