JUSTIFICATION AND APPROVAL JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION ONLY ONE RESPONSIBLE SOURCE (SOLE SOURCE) 5 October 2015 1. REQUIRING ACTIVITY/CONTRACTING ACTIVITY: The requiring activity is the Wyoming Army National Guard Recruiting and Retention Office located in Cheyenne, WY 82009. The contracting Activity is the USPFO for Wyoming Purchasing and Contracting department located in Cheyenne, WY 82009. 2. NATURE/DESCRIPTION OF CONTRACT ACTION: This is a sole source action to be awarded as a Purchase Order with firm fixed pricing to SpeedTracs America, LLC, 118 Sloan St., Roswell, GA, 30075. 3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed procurement is for the WY ARNG's purchase of the SpeedTracs National Guard Fitness Challenge program for the 2015-2016 academic year. 4. IDENTIFICATION OF AUTHORITY: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements, as implemented by FAR 6.302-1. The content of this Justification and Approval is written in accordance with FAR 6.303-2. 5. CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF ACQUISITION: SpeedTracs LLC is the sole provider of the National Guard Fitness Challenge. The fitness challenge is a series of workouts that provide participants with an overall score. The Wyoming Army National Guard is using the SpeedTracs system as a recruiting tool in local high schools. The guard members will administer the test to local high school athletes and allow their scores to compete against fellow athletes across the state and the nation. The SpeedTracs system will allow Wyoming Army National Guard members to work with high school athletes who are a targeted age demographic. 6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY SOURCES AS PRACTICABLE: This acquisition was placed on FBO from 9/1/15 - 9/9/15 as a "Sources Sought" posting and zero sources were identified (Solicitation #W912L3-15-T-0012). 7. FAIR AND REASONABLE COST: The price has determined to be fair and reasonable by comparing sponsorships rates for Wyoming compared to the rates paid by other states. 8. MARKET SURVEY: FBO Announcement was issued looking for other sources that can supply an item capable of meeting the government's need. 9. LIST OF SOURCES THAT EXPRESSED INTEREST: No sources expressed interest nor responded to the FBO Announcement. 10. This agency will continue to use FBO and market research to seek sources who are capable of offering similar services. 11.
