The State of Utah Division of Purchasing, acting on behalf of the Utah Department of Corrections, is soliciting bids for the supply and delivery of decorative multi-colored rock—specifically pink and gray varieties—in a fixed-budget procurement of $400,000.00, with the goal of maximizing total tonnage under this budget. Deliveries must be completed no later than June 30, 2026, with no exceptions permitted. The contract will be awarded to the single responsive and responsible vendor offering the lowest all-inclusive cost per ton, ensuring the highest possible volume of material within the allocated funds. The eventual Purchase Order will require an even split between the two rock types, with pricing expectations ranging from $24.80 to $34.98 per ton depending on color and vendor, and total projected costs for each color aligning to a combined $400,000. Bidders must guarantee their pricing through project completion and comply with all state-specific contractual and operational requirements. This procurement follows a Lowest Price Technically Acceptable (LPTA) methodology, where all vendors must first meet mandatory pass/fail criteria including timely submission, compliance with submission formats, proof of E-Verify registration, adherence to Utah’s restrictions on forced labor and restricted foreign entities under UCA 63G-6a-121, and certification of anti-boycott compliance. Vendors must also provide proof of insurance coverage including $1 million per occurrence commercial general liability, workers’ compensation as required by law, and commercial auto liability with the State named as an additional insured. All deliveries are F.O.B. Destination Freight Prepaid and Allowed, meaning the contractor bears all transportation costs and risks until acceptance at the Central Utah Correctional Facility in Gunnison, Utah. Inspection and acceptance occur upon delivery, with the State having 30 days to reject nonconforming goods. Contract terms bind the vendor to Utah law, require full indemnification of the State, mandate compliance with GRAMA for public records transparency, prohibit assignment without approval, and assign all work product ownership to the State. Proposals must be submitted electronically via the U3P portal by May 28, 2026, and any deviation from solicitation terms will render a bid non-responsive. No federal FAR clauses apply; all provisions are governed by Utah state statutes and procurement rules.
