No legal liability on the part of the Government for any payment may arisefor performance under this contract beyond 09/30/2026, until funds are made available to the Contracting Officer forperformance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.


The Contractor shall not initiate shipment of any awards under this contract until a funded purchase order has been issued, or express written authorization is provided by the Contracting Officer. Unfunded purchase orders may be issued solely to authorize the Contractor to commence production preparation and staging of awards. The Government assumes no legal liability for shipment or delivery under an unfunded purchase order until the Contracting Officer executes a formal contract modification to incorporate the necessary funds.
