Notice of Intent to Award Sole Source Procurement. The Government intends to issue a sole source contract to construct a new ladder and safety climb system extending the full length of a 625-foot guyed LORAN C tower. The new ladder will conform to OSHA standards and provide a significantly safer means of inspecting and conducting maintenance on the tower. Award will be made on a sole source basis to Stainless LLC, 1140 Welsh Road, Suite 250, North Wales, PA. 19454-4205. The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 (a)(2)(iii) , �Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements�. This notice is not a request for competitive proposals. Determinations not to compete this proposed procurement were made because Stainless LLC is the original designer and own the proprietary rights to the drawings.
