The contract requires the furnishing of Regular Unleaded Gasoline (87 Octane), Super Unleaded Gasoline (93 Octane), and B2 Diesel (2% biodiesel) to participating municipalities within Montgomery County, Pennsylvania, with deliveries scheduled to begin September 1, 2026, and conclude August 31, 2027. Pricing is based on the weekly OPIS Philadelphia average published every Monday, plus a bid-specific delivery charge in cents per gallon, with no guaranteed volumes—quantities provided are estimated only. Bids must include a certified check or bid bond equal to 10% of the proposed bid amount, payable to Upper Merion Township, along with a Consent of Surety from a surety licensed in Pennsylvania. Upon award, the successful bidder must furnish Performance and Labor and Material Payment Bonds totaling 50% of the contract value under the Public Works Contractors’ Bond Law of 1967. Fuel must meet all federal and state standards, including Pennsylvania’s B2 biodiesel mandate, and be free from water or contaminants, with delivery verification occurring at municipal storage sites. Invoices must reference the applicable OPIS pricing and separately itemize USTIF and LUST fees, but no electronic invoicing system like WAWF is mandated. The award will go to the lowest responsible bidder on a Lowest Price Technically Acceptable basis, with Upper Merion Township retaining the right to reject any or all bids and waive minor irregularities. All bidders must affirm compliance with affirmative action requirements prohibiting discrimination in employment and submit mandatory forms including a Non-Collusion Affidavit, Workers’ Compensation Insurance certification, Commercial Driver’s License verification, and Public Works Employment Verification. The contract is administered by Upper Merion Township, with payments managed by individual participating municipalities; no named contracting officer, representative, or accounting data is specified, and no option periods, security clearances, or key personnel requirements are included.
