The Department of Defense, specifically the W6QM Micc-Ft Campbell, entered into a firm-fixed-price contract for the procurement of DUET Chemical ULV Insecticide Concentrate. This acquisition was conducted on a sole source basis under solicitation W9124811T0044, as Clarke Environmental Mosquito Management, Inc. is the exclusive distributor of the product manufactured by McLauglin Gormley King Co. The procurement was necessary to satisfy the mission requirements of the Directorate of Public Works to combat pesticide resistance in local mosquito species. Because this specific brand name commercial item was determined to be the only insecticide in rotation capable of meeting performance standards, the agency utilized non-competitive procedures in accordance with FAR regulations for authorized resale and simplified acquisition thresholds.

This contract action was accomplished using other than competitive procedures because the agency's need is for a brand name commercial item for authorized resale (FAR 6.302-5). A J&A is not required, per FAR 6.302-5. The DUET Chemical ULV Insecticide Concentrate is the only insecticide that is in rotation and that meets performance requirements to satisfy mission need of the Directorate of Public Works (DPW). These requirements are necessary to combat pesticide resistance in the species of Mosquitoes requested by Directorate of Public Works (DPW). The procurement will be conducted on a sole source basis in accordance with the FAR 13.106-1(b) (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name or industrial mobilization). The Agency intends to enter into a firm-fixed-price contract with Clarke Environmental Mosquito Management, Inc. The basis for restricting competition is that Clarke Environmental Mosquito Management, is the sole distributor of DUET Chemical ULV Insecticide Concentrate which is manufactured by McLauglin Gormley King Co. and it is the only known insecticide capable of meeting the Government's needs.
