The U.S. Small Business Administration (SBA) is considering waiving the Nonmanufacturer Rule for a variety of furniture-related products and services under the North American Industry Classification System (NAICS) code 423210. This waiver pertains to furniture categories including merchant wholesalers, manufacturing of office furniture, furniture design services, and manufacturing of furniture parts in metal, wood, and plastics, among others, excluding drafting tables, hospital beds, and medical furniture. The Nonmanufacturer Rule typically requires that small business contractors supply products manufactured by small businesses; however, the SBA is proposing this waiver because no small business manufacturers have been found to supply these types of furniture products to the federal government recently. If granted, the waiver would allow qualified regular dealers to provide the products of any domestic manufacturer on federal contracts set aside for small businesses, service-disabled veteran-owned small businesses, or SBA’s 8(a) Business Development Program participants. The SBA invites public comment within 15 days from the publication date regarding this proposed waiver, seeking information about small business manufacturers currently capable of participating in the federal market for these furniture products. The waiver request aligns with the statutory authority under Section 8(a)(17) of the Small Business Act and SBA regulations, designed to balance support for small businesses with practical market considerations when no eligible small manufacturers are available.
