The Department of Construction Research Center (CRC) of the National Research Council Canada has a requirement to collect in-factory and post-delivery airtightness test data of modular construction in Canada which will support CRC’s analysis supporting proposed code development. The work will involve the following: enrolling 6 to 10 housing manufacturers, conducting between 150 and 200 total in-factory and post-delivery airtightness tests on a representative dataset (including geographically diverse in-factory and post-delivery locations), providing energy advisor (EA) reports, data and metadata on modular homes in the study and developing a summary report of the results. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: Experience: Established (at least 5 years) and trusted relationship with modular construction industry (at least 6 large Canadian manufacturers operating from / delivering to geographically diverse areas of Canada). Knowledge and understanding of: modular construction industry issues, including with transport and delivery of modular homes, working with EAs and builders for code compliance, and trusted with modular construction industry data. This procurement is subject to the following trade agreement(s) : o Canadian Free Trade Agreement (CFTA) o Canada-Chile Free Trade Agreement (CCFTA) o Canada-Colombia Free Trade Agreement o Canada-Honduras Free Trade Agreement o Canada-Korea Free Trade Agreement o Canada-Panama Free Trade Agreement o Canada-Peru Free Trade Agreement (CPFTA) 5. Justification for the Pre-Identified Supplier The work involves gathering pre- and post-delivery air tightness testing data of houses of at least 150 factory-built houses from 6-10 manufacturers and analyzing the results to be presented in a report. This will involve close coordination and verification of financial records with the manufacturers chosen as well as a knowledge of industry issues and buildings science. Crucially, manufacturers will also be divulging the results of the air tightness tests on the houses they’ve built (and the name(s) of energy advisor companies that the manufacturer works with). The Canadian Home Builders' Association (CHBA) have existing relationships with all proposed manufacturers and is a trusted representative for their housing industry members including the manufacturers of factory-built modular construction in Canada. Given the sensitive nature of the data and information these manufacturers will be providing, CHBA is the only trusted partner for the manufacturers and therefore it is not sensible to compete the requirement. The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". Ownership of Intellectual Property Canada intends to retain ownership of any Foreground Intellectual Property arising out of the proposed contract on the basis that the main purpose of the contract is: Where the main purpose of the Crown Procurement Contract, or the deliverables contracted for, is: 4.1 To generate knowledge and information for public dissemination. The proposed contract is expected from November 1, 2024 to September 30, 2025. The estimated value of the contract is $175,500.00 (GST/HST extra). The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The closing date and time for accepting statements of capabilities is October 25, 2024 at 2:00 p.m. (ET).
