The Seattle District of the US Army Corps of Engineers intends to award a sole-source fixed-price contract to Salish-Kootenai College, an educational institution affiliated with the Confederated Salish and Kootenai Tribes (CSKT) of the Flathead Reservation in Montana. This contract, which includes a base period and four option years, will provide curation services for cultural resource collections from the Libby Dam Project. These services encompass the professionally supervised storage, maintenance, and management of diverse materials such as artifacts, soil samples, charcoal, skeletal remains, artworks, and other archaeological items associated with the project. The award is justified under federal acquisition regulations allowing sole-source contracting when only one responsible source exists, given the unique trust relationship with the CSKT and the specific cultural and legal considerations involved. The project is governed by several federal laws and regulations, including the Native American Graves Protection and Repatriation Act (NAGPRA), which designates the Kootenai Tribe component of the CSKT as the official representative for Native American tribes with rights over the collections. The site falls entirely within lands ceded under the Hellgate Treaty of 1855 and involves management protocols consistent with the National Historic Preservation Act, the Reservoir Salvage Act, and Corps of Engineers regulations. Due to the sensitive nature of the materials and the tribal trust responsibilities, no other organization is authorized or capable of performing these services. The contract falls under the NAICS code 611310, with a size standard of $7 million, and reflects the federal government’s commitment to preserving Native American cultural heritage within a legal and respectful framework.

This project is entirely within the CSKT ceded lands. The CSKT is the sole representative for Native American tribes with NAGPRA jurisdiction at the site. Due to the project's geographic location and trust relationship with the CSKT, there is no other authorized organization capable of performing NAGPRA services. This action is in accordance with NAGPRA provisions at 43 CFR Part 10, Subpart B governing Agency action regarding Human Remains, funerary objects, sacred objects, or objects of cultural patrimony from Federal or Tribal Lands.
