RFI number 2 for Information Products Commodity[DPI no 2 pour les produits d'information]
Solicitation # CW2474502
Public Services and Procurement Canada (PSPC) is conducting a follow-up Request for Information (RFI) under solicitation number CW2474502 to gather industry feedback for the development of a procurement strategy regarding Information Products and related services. This consultative process focuses on defining data categories, procurement models for static and outcome-based content, and general terms and conditions, specifically regarding liability and indemnification. The RFI explicitly excludes satellite imagery and seeks to balance technical merit, price, and contractual acceptability. Responses are due by March 31, 2027. Proposed contractual frameworks include a performance management system based on cost, quality, schedule, and management, with a verification period of ten business days for the acceptance of licensed products. Key terms under consideration include a liability cap limited to the contract value of the preceding 12 months and a requirement for content authenticity to ensure human authorship over AI-generated content. The procurement strategy is exploring various award models, including a highest-ranked bidder negotiation process and a scoring system that favors suppliers who accept Canada's contractual framework without amendment. Payment is slated for 30 days following the receipt of an undisputed invoice via electronic instruments.

AI Contract Overview

The Commodity Futures Trading Commission (CFTC) plans to negotiate and grant a sole-source contract modification with the London Stock Exchange Group (LSEG) for additional Eikon Premium Subscriptions. Currently holding six subscriptions, the CFTC aims to acquire four more to enhance its commodity and financial data feeds. This requirement is intended to be met under the "Only One Responsible Source" stipulation and spans the remaining four option years of the contract (9523ZY24C0005) until January 31, 2029. Eikon's exclusive data services are deemed crucial for the CFTC's regulatory functions, especially in fast-evolving markets such as liquefied petroleum gases (LPG), electric power swap futures, and foreign exchange (FX). Eikon's data offerings are unmatched in the market and include services like the Daily Eikon LPG Report for markets such as propane and natural gasoline, and the Power USA Locational Marginal Pricing Service, which is critical for monitoring electrical power markets. Additionally, its foreign exchange data, pivotal to a USD $74 trillion market in FX swaps, includes comprehensive market activity and analysis that are indispensable for the CFTC. Without access to this data, the CFTC's ability to fulfill its regulatory mission would be significantly hampered. While this notice is not a competitive solicitation, responses from potential vendors demonstrating capability are welcomed until January 21, 2025, with the contract award expected around January 31, 2025.

The Commodity Futures Trading Commission ("CFTC") intends to negotiate and award a sole-source modification on an existing contract (9523ZY24C0005) with the London Stock Exchange Group (LSEG) for the procurement of additional commodity and financial data feeds.

Specifically, CFTC intends to procure four additional Eikon Premium Subscriptions.  CFTC currently has six Eikon Premium Subscriptions.  CFTC intends to procure this requirement under FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.  CFTC intends to modify this contract to add these additional licenses for the four remaining option years of contract 9523ZY24C0005 (through January 31, 2029).

The data provided by LSEG and its Eikon service is unique to LSEG and cannot be obtained via any other source.  The areas that are unique to Eikon are as follows:

  (a) Daily Eikon LPG Report: The report is for Propane, Butane, Isobutane, Natural Gasoline, and Ethane markets. LPG (liquefied petroleum gases) is a new active futures market for the CFTC and one that has increased rapidly in importance with the increase in shale oil and hydraulic fracking for natural gas.

  (b) Power USA Locational Marginal Pricing (LMP) Interactive Service is a report updated every 10 minutes for the generation, transmission, and load data of electrical power markets that serves as the underlying cash market for nearly 1,500 futures contracts the CFTC monitors. This data and the accompanying information service overlay functions that are critically important to the CFTC electric power swap futures analysis and research efforts.

  (c) Foreign Exchange (FX) data is not available via any other source that contains physical market activity. FX Swaps are a USD $74 Trillion notional market that the CFTC regulates. FX Fixed Income Price Service is a valuable reference to activity and market data on FX prices and spreads. Data on daily activities, analysis reports, bank news and pricing information to compare with Swap Data Repository (SDR) data is only available from Eikon.

Without access to this data, CFTC’s regulatory operations would be significantly impeded and there would be an increased risk to achieving CFTC’s mission.
