Title: COLLECTION OF SURFACE WATER SAMPLES FOR PESTICIDES ANALYSIS IN THE WESTERN RED RIVER VALLEY REGION OF MANITOBA. Solicitation Number: 1000265832 1. The Purpose and Explanation of an ACAN An Advance Contract Award Notice (ACAN) allows Health Canada to post a notice for no less than fifteen (15) calendar days, indicating to the supplier community that a goods, services or construction contract will be awarded to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the minimum requirements identified in the ACAN, the Contracting Authority may then proceed to award a contract to the pre-identified contractor. 2. Rights of Suppliers Suppliers who consider themselves fully qualified and available to provide the services or goods described in this ACAN may submit a Statement of Capabilities demonstrating how they meet the advertised requirement. This Statement of Capabilities must be provided via e-mail only to the contact person identified in Section 12 of the Notice on or before the closing date and time of the Notice. If the Bidder can clearly demonstrate they possess the required capabilities, the requirement will be opened to electronic or traditional bidding processes. 3. Proposed Contractor Manitoba Métis Federation – National Government of the Red River Métis 150 Henry Ave Winnipeg, Manitoba, R3B 0J2 4. Definition of Requirements or Expected Results Health Canada’s Pest Management Regulatory Agency (PMRA) evaluates the risks to human health and the environment associated with the use of pesticides and regulates pesticide products in Canada. In the interest of increasing the availability of real-world data for use in pesticide risk assessments, the PMRA is implementing a Canadian Water Monitoring Program for Pesticides (CWMPP). As part of this program, water samples are analyzed to determine the concentrations of pesticides present in Canadian waters. Federal laboratories will analyze approximately 200 chemicals (i.e., pesticide active ingredients and transformation products) in water from various regions across Canada. The information is being collected to use in pesticides regulatory decisions, as appropriate. The PMRA requires the services of a contractor to carry out water sampling at specified sites in the western Red River Valley region of Manitoba in 2025-26 and up to one option year. The generated pesticides data will be provided to the Contractor, and, in support of the PMRA’s goal of increasing transparency, will also be shared publicly through the Government of Canada Open Data portal. The Contractor is to provide the necessary field equipment to collect all samples and data. Note that the Contractor is to generate their own shipments to laboratories using federal Purolator or FedEx account information provided by the PMRA. The receiving laboratories will be responsible for return cooler shipments (by ground). The 4 sites to be sampled up to twice weekly are: Please see attachment 5. Minimum Requirements Any interested supplier must demonstrate by way of a Statement of Capabilities that it meets the following minimum requirements: ? Experience: A minimum of 1 year of experience in conducting water quality sampling for currently registered pesticides or other anthropogenic contaminants. ? Knowledge and understanding of: water quality sampling equipment and techniques. 6. Reason for Non-Competitive Award Section 6 of the Government Contracts Regulations contains four exceptions that permit the contracting authority to set aside the requirement to solicit bids. For the proposed procurement, the following exception applies: (d) Only One Person or Firm is capable of performing the contract 7. Applicable trade Agreements and Justification for Limited Tendering or the Procurement Strategy for Aboriginal Business This procurement is subject to the following: Mandatory PSIB Set-Aside The trade agreements that Canada is signatory to provide for the inclusion of measures for Indigenous businesses in a procurement, such as setting aside a procurement under PSIB. Procurements set-aside under PSIB are removed from the obligations of the applicable trade agreement, and therefore are also no longer subject to the purview of the Canadian International Trade Tribunal (CITT). 8. Ownership of Intellectual Property Crown Owned – Public Dissemination. 9. Period of the Proposed Contract The contract period shall be from approximately the 25th of July 2025 until the 31st of March 2026, including One (1) Option Year – April 1, 2026 to March 31, 2027. 10. Security Requirement Advance Contract Award Notice There are no Security Requirements associated with this proposed Contract. 11.
