AI Contract Overview
Hillsborough County plans to award a sole source contract to Powerscreen of Florida, Inc. for five years of maintenance, repairs, and parts supply to keep one Komptech Cribus 3800 separating screen and two Komptech Topturn X63 windrow machines operational at the SE Landfill for composting operations. The estimated contract value is $1,992,824.18, covering scheduled service intervals at 1250, 1500, and 2750 hours for the Topturn X63 units and 2000, 2500, and 4000 hours for the Cribus 3800, along with labor at $225 per hour for standard work and $350 per hour for non-standard hours, plus a $200,000 allowance for unlisted parts. The award is justified under Section 3-205(2)(e) of the County’s Procurement Policy because Powerscreen is the sole authorized Komptech dealer in Florida with exclusive access to proprietary parts and technical expertise. The contract includes F.O.B. Destination shipping terms, strict invoicing requirements with payments governed by Florida’s Prompt Payment Act, and a six-year record retention mandate. Vendor compliance with Florida Statutes Section 448.095 is required through E-Verify enrollment for all employees and subcontractors, and all workforce documentation must align with federal and state employment eligibility laws. Non-discrimination obligations and liability indemnification are explicitly included, and the County reserves rights to adjust scope, extend duration, or modify pricing based on operational needs. The contract prohibits assignment without prior written approval and mandates monthly reporting through the B2GNOW system to track Small Business Enterprise subcontracting goals. All challenged bids must be submitted via EUNA Procurement by the June 25, 2026 deadline with clear and convincing evidence to demonstrate competition exists, otherwise the award to Powerscreen will proceed. Risk of loss remains with the vendor until formal acceptance, and rejected materials must be removed at the vendor’s expense within ten days.
