The U.S. Army Corps of Engineers, Portland District, intends to award a non-competitive, out-of-scope modification to contract W9127N24C0011 with Manson Construction Co. for critical maintenance dredging at the Charleston Harbor Federal Navigation Channel. This sole source action is justified because Manson Construction Co. is already mobilized in the area with the necessary equipment, making them the only source capable of completing the work within the required timeframe without causing substantial duplication of costs to the government. Under this modification, the contractor will provide the labor, materials, and equipment to remove approximately 15,000 cubic yards of material using a clamshell dredge. Work is scheduled to begin in mid-November and must be completed by November 30, 2024, to comply with the in-water work window. The project falls under NAICS code 237990, and no formal solicitation will be posted.

The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 6.302-1 and DFARS 206.302-1, Only one responsible source and no other services will satisfy agency requirements. Through the intended modification the contractor shall provide labor, materials, and equipment to perform critical maintenance dredging at within the Charleston Harbor navigation channel. The Government intends to proceed with this sole source action. A SOLICITATION WILL NOT BE POSTED. The NAICS code is 237990. The size standard is $37M for the NAICS code defined by the U.S. Small Business Administration. THIS NOTICE IS NOT A REQUEST FOR PROPOSAL.
