CYBER THREAT ETM VOICE NETWORK SYSTEM

JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND OPEN COMPETITION/BEYOND TRUST(RETINA) JUSTIFICATION 1. The Office of Acquisition Management is conducting this acquisition for ETM Firewall maintenance and support renewals on behalf of the U.S. Department of State (DoS). Cyberthreat Analysis Division (DS/SI/CS/CTAD. This acquisition is for a base plus two (2) option renewal years for an estimated cost is $. 2. Nature and/or description of the action being approved. DS/SI/CS/CTAD has been using SecureLogxi Enterprise Telephon (ETM) for the last several years. The use of Span Customer Care Bundle (SW Maintenance, Upgrades, and Technical Support is essential in support of the Department's Enterprise Telephony (ETM) system. The use of a brand name description is essential to the identified requirements, thereby precluding consideration of the products of another source. 3. A description of the supplies or services required to meet the Department's needs. The Department has a requirement for maintenance renewals to support the existing Enterprise Telephone (ETM) system infrastructure. The existing ETM currently deployed by CTAD is well within its useful life and the applications identified herein are vital to the strength, security, and cost-effectiveness of the Department's network infrastructure. Specifically, the Department requires: Customer Care Bundle (Per Span, SIP License, and 1000 Series Appliance) for Software Maintenance, Upgrades, and Technical Support (Part# ETM-CARE-BUNDLE). 4. An identification of the statutory authority permitting other than full and open competition: 41 U.S.C. 253(c) (1), and FAR 6.302-1-(c)-(1).Only one responsible source and no other supplies or service will satisfy agency requirements: This action is processed under fair opportunity exception. Only one awardee (brand name) is capable of providing the supplies or services required because the supplies or service ordered are unique or highly specialized, as follows: The required items are proprietary, (ETM) software products are already in use by the DoS. The proprietary software code is available only from the manufacturer and authorized partners, and therefore precludes consideration of any other brand. Thus, only one source is capable of responding due to the unique or specialized nature of the work. The efficiency and security of (ETM-CARE-BUNDLE) software in use is dependent on renewal of (ETM) software maintenance to preserve the current DoS IT network and infrastructure. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. The required items are proprietary to ETM Voice Firewall licenses already in use by the DoS. The proprietary code is available only from the original manufacture, SecureLogix, Inc, and authorized partners, and therefore precludes consideration of any other brand. Thus only one source is capable of responding due to the unique or specialized nature of the work. The efficiency and security of the ETM infrastructure in use is dependent on the renewal of the maintenance bundle to continue the preservation of the current DoS infrastructure. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. As required by FAR 5.2, a notice will be publicized on FedBizOpps to provide fair opportunity by brand name (Open Market) Small Business to manufactures and authorized resellers. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: This competition is limited to manufactures and authorized resellers only. Based on the brand name justification, public commercial pricing and the amount resellers in the industry, the Government anticipates offers will be fair and reasonable 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. ETM Voice Firewall products currently deployed are proprietary hardware support and Are proprietary hardware support and software code through authorized resellers of Secure Logix, Inc is the manufacture. 9. Any other facts supporting the use of other than full and open competition. As this is a brand name only Justification, no one contractor's unique qualifications are used as the basis for this justification. Rather the products identified by brand herein have been identified as the only products that will meet the Department's storage environment. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. Sunturn, Secure Logix, and ImmiTechnology, Inc, which are manufactures and authorized resellers. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. At this time the current ETM infrastructure deployed by the DoS does not allow for any additional industry solutions. However, as DoS deployed infrastructure evolves with industry technology, further solutions will be considered competitively.
