The Canyons School District in Utah intends to award a contract directly to Follett Software LLC for the renewal and support of the Destiny Library Management System without engaging in a standard procurement process. This decision is based on the unique circumstances outlined in Utah Administrative Code rules, which recognize that the district has a longstanding, customized relationship with Follett Destiny, serving as its primary library management system since 2009. The district manages over 700,000 materials across its schools, and migrating to a new system would incur significant costs, operational disruptions, and potential loss of asset records. Therefore, compatibility, ongoing support, and the tailored integration of Follett Destiny are considered overriding factors, making this a sole-source procurement. The district plans to purchase this support and maintenance for a five-year period, starting December 1, 2024, with an estimated annual expenditure of approximately $100,000 for system renewal and $10,000 for compatible equipment, totaling around $400,000 if extended for four additional years. The contract includes renewal of licenses, ongoing technical support, and equipment necessary for district-wide library operations, ensuring continuity and efficiency in managing a large collection of materials. The procurement aligns with the district’s need to maintain seamless library services, avoid costly migrations, and leverage existing customized solutions. The notice emphasizes that no action is required from interested parties if they agree with the intent, and it provides contact details for further information. The procurement is governed by district standard terms and conditions, and the decision underscores the importance of system compatibility and support renewal as the primary justification for bypassing the standard competitive bidding process.

This is a notice of intent to award without engaging in a standard procurement process. It is not a request for quotes, bids or proposals. DO NOT submit questions, bids, no-bids or other information in this system.    NO ACTION IS REQUIRED IF YOU AGREE WITH THIS NOTICE.   The Utah Procurement Code provides that a purchase may be made without engaging in a standard procurement process if it can be determined in writing that:    there is only one source for the procurement item;    transitional costs are a significant consideration in selecting a procurement item; or   the award of a contract is under circumstances, described in rules adopted by the applicable rule making authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit.
Requesting School/Department: Instructional Supports for All Schools District-wide
Product and/or service to be purchased: Destiny Library Management Online License Renewal and additional supports for district library management system, including additional supports of textbook, resource manager, and the equipment necessary to continue the program.    Earliest date purchase may occur: 12/1/2024    Proposed Supplier: FOLLETT SOFTWARE LLC
Justification: The award of a contract is under circumstances, described in rules adopted by the applicable rule making authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit.   Compatibility is the overriding consideration Utah Administrative Code (Rule) R33-8-101c(1) (c) and maintenance and support renewal Utah Administrative Code (Rule) R33-8-101a(2(c).    Follett Destiny has served as the district’s library and resource management system since Canyons School District's inception in 2009 and has been tailored specifically to meet the district's evolving needs. This long-standing customization ensures a seamless integration of services and functions, allowing school libraries to manage the district’s 370,000+ material collection efficiently from purchase to processing to access. Currently, the Destiny resource management system also tracks 350,000+ additional items across the district.
Migrating to a new library management system without justification would incur the significant costs of reprocessing over 700,000 items and would require extensive time and training for implementation, adaptation, and adoption. The possibility of costly service disruptions and the loss of asset records during a migration also makes the move prohibitive. Furthermore, Follett Destiny’s current proposal includes the continued investment in compatible software and equipment essential for smooth library and resource management operations, reinforcing Follett Destiny as the most efficient and cost-effective choice for the district.
Length of notice: Canyons School District intends to purchase the maintenance and additional supports for this system for the next five years, thus this notification will be considered official notification 12/1/24 through 11/30/2029.   Anticipated expenditure: Approximately $100,00.00 per year for district library management system, $10,000.00 per year in compatible equipment (this estimated yearly total would be if all schools replaced multiple pieces of equipment). Approximately $400,000.00 if renewed for an additional four years.
