Discovery Services

Washington State Department of Enterprise Services is establishing a cooperative Master Contract for professional Discovery Services to support litigation, claims, and other legal matters for state agencies and eligible purchasers. The scope of work encompasses the collection, analysis, storage, and production of digital and hardcopy records, following the best practices of the Electronic Discovery Reference Model. Services must adhere to Washington Technology Solutions Standards and include compliance with HIPAA and HITECH. The contract is structured to provide up to four main awards for general discovery services and one award for providers with FEDRAMP and CJIS certifications, with additional reserved awards for Washington Small Businesses and Certified Veteran-Owned Businesses. The award process is based on a scored evaluation of non-cost factors, with additional preference points available for compliance with Executive Order 18-03 regarding worker's rights. Bidders must meet strict submission guidelines, including a three-page limit per category in a specific Word format, with a response deadline of January 15, 2027. Contract administration includes a 30-day cure notice for defaults and a 30-day payment term from the date of invoice. All deliverables are shipped FOB destination with freight prepaid by the contractor, and the purchaser is responsible for final inspection and acceptance at their destination.
