AI Contract Overview
Clean Water Services is soliciting proposals for a three-year contract to provide independent engineering plan review services, commencing July 1, 2026, with a maximum contract value of $1,000,000. The scope includes reviewing storm and sanitary sewer systems, stormwater quality and quantity controls, erosion control measures, and easement compliance against the District’s Design and Construction Standards. Consultants must act solely as technical reviewers without authority to bind the District and may perform services remotely or at designated administrative facilities in Hillsboro or Beaverton, Oregon, with required in-person participation in meetings. Proposals must be submitted electronically via Equity Hub’s Bid Locker by 2:00 p.m. local time on May 22, 2026, and are limited to 15 pages excluding covers and appendix, with strict formatting requirements including 12-point Times New Roman font and single spacing. Evaluation is based on technical merit using a weighted scoring system: 60% for the qualifications and continuity of the designated primary plan reviewer, 30% for the understanding of the scope and approach to service delivery, and 10% for the overall experience and capacity of the firm, supported by three client references. Award will follow a trade-off process prioritizing overall value over lowest price, with selected proposers entering negotiations after the technical evaluation. Contract terms mandate compliance with Oregon law, professional liability insurance of $1 million per claim and $2 million aggregate with the District named as additional insured, cyber and pollution liability coverage of $1 million each, workers’ compensation as required by law, and five years of tail coverage. The Consultant must waive indemnity rights under the Oregon Tort Claims Act, prohibit contingent fees, avoid conflicts of interest including financial interests in recommended products or contractors, and ensure confidentiality and data security in line with District standards. Invoices must be submitted monthly via email to a designated District supervisor, with no formal payment office or electronic invoicing system specified. The District reserves the right to terminate without cause, reject noncompliant proposals, or cancel the solicitation in the public interest, and accepts deliverables based solely on its inspection against established standards. All contractual obligations, including survival of certain clauses, assignment restrictions, dispute resolution via mediation, and governing law, are defined under Oregon jurisdiction with venue in Washington County.
