Text Amendment Application No. P25-00974 is a legislative action by the City of Fresno Planning and Development Department to modify the Fresno Municipal Code, specifically Chapter 15, Table 15-1102 and Section 15-2728. The amendment allows existing establishments with drive-through facilities to relocate to a site within 100 feet of a planned or existing Bus Rapid Transit station if the relocation is necessitated by eminent domain. To qualify for this exception, the new site must be located within one half mile of the original location, and all other standard drive-through design guidelines remain applicable. This action is classified as a textual amendment and does not involve a physical project or specific development commitments. Consequently, the City of Fresno has issued a CEQA Notice of Exemption based on the common sense exemption under Section 15061(b)(3), as the changes are minor and do not result in physical alterations. The project applies to all areas within the corporate boundaries and jurisdiction of the City of Fresno, with Erik Young serving as the Supervising Planner and primary point of contact.
