The USDA has established an internal Alternative Dispute Resolution process through its Ombudsman Program for Agency Protests to resolve procurement concerns without resorting to external forums like the GAO. Formal protests must include all information required by FAR 33.104(a)(3), be filed within prescribed timelines, and be submitted electronically to SPE.inquiry@usda.gov and the Contracting Officer. Filing a formal protest with the USDA suspends contract award or performance unless the government justifies continued activity for urgent or compelling reasons. The agency aims to resolve protests within 35 calendar days, and by initiating an agency protest, the proposer forfeits the right to pursue the same issue externally while the agency review is ongoing.
