Full Description

The United States Army Corps of Engineers (USACE), Engineer Research and Development Center (ERDC) Contracting Office intends to issue a sole source award to Ball Aerospace Technologies Corporation, (address) for one (1) GMAPD camera: Sync128x32, Full Spectrum, Cameralink, Air-Cooled, Standard-grade. Ball Aerospace Technologies Corporation is the sole commercial manufacturer and supplier of Gieger-mode type lidar cameras for geospacial applications. This technology is protected by intellectual property that was originally developed by Massachusetts Institute of Technology's Lincoln Laboratory (MITLL), and was ultimately transferred to Ball Aerospace Technologies Corporation, which holds the exclusive license. No other manufacturer or supplier exists. This procurement action is exercised as sole source pursuant to authority of FAR 6.302-1(2), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, and 10 U.S.C. 2304(c)(1), Contracts: competition requirements for the purpose of providing written consent and approval to award on an other than full and open competition basis. This notice is not a request for competitive quotes or proposals. A solicitation will not be issued. However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. The information submitted must be provided in sufficient detail to demonstrate the vendor's ability to fulfill this requirement. The contractor must also provide a description of their past experience in fulfilling requirements which are the same or similar to this requirement and references for each. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this requirement on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government.
