AI Contract Overview

The Department of Homeland Security (DHS) has announced the resumption of normal contracting activities effective October 17, 2013, following a funding hiatus. The recently enacted Continuing Resolution (CR) funds DHS operations through January 15, 2014, though funding allocations to individual DHS components are still being determined. Contractors are informed that provisions of the CR may affect fiscal year 2014 contract actions, and DHS is currently assessing how the lapse in appropriations impacts existing contracts. Those contractors previously issued stop work orders, modifications, or termination notices will receive guidance on subsequent steps from their Contracting Officers. Contractors whose contracts were unaffected by the lapse should continue to comply with all contract terms and requirements unless otherwise instructed. DHS expresses appreciation for the contractor community's patience and cooperation during the funding interruption and underscores the importance of maintaining contractual obligations during this transitional period. Communication channels remain open through designated contacts, including the DHS Industry Liaison, for any questions or clarifications. This measure ensures a managed and orderly return to standard operations, maintaining the integrity of contract performance while adapting to the funding constraints dictated by the Continuing Resolution.

Full Description

DHS Industry Partner, This is to advise the Department of Homeland Security (DHS) contractor community that DHS plans to return to normal activity on October 17, 2013. We recognize that industry has persevered through the funding hiatus and we appreciate the support. As you are aware, the recently enacted Continuing Resolution (CR) provides funding for DHS through January 15, 2014. Please note that each CR includes specific terms and limitations. At this time, each DHS Component's portion of the CR funding is being allocated. You are advised that even when funding is available to the Component, the Component's planned FY 2014 contract actions may have changed. We are currently reviewing the CR provisions and assessing the impact of the lapse in appropriation on our contracts. If you were contacted by your Contracting Officer with a stop work order, modification or a termination notice, the Contracting Officer will provide appropriate notice as to the next steps in the process in accordance with the terms and conditions of the affected contract. If your contract was not affected by the lapse in appropriations, DHS does not plan to provide any separate notifications. Unless you receive a notification to the contrary, all OHS contractors must continue to comply with all terms, conditions, requirements and deliveries specified in their contracts. Thank you for your continued partnership with DHS. Sincerely, Nick Nayak Chief Procurement 0fficer
