AI Contract Overview

This contract is a sole source procurement for preventative maintenance and repair services exclusively provided by the Original Equipment Manufacturer (OEM), TRUMPF. The justification for this sole source determination is based on the proprietary software rights held by TRUMPF and the necessity of a certified TRUMPF technician to perform the work and authenticate the software. The specialized capabilities of the TRUMPF laser cutter, which are not available in other equipment at Portsmouth Naval Shipyard, make it impossible for alternative solutions to meet the agency’s requirements efficiently. The contract is issued under authority of 10 USC 2304(c) and FAR 13.106-l(b)(l), emphasizing that no other supplies or services can satisfy the agency’s needs. The solicitation, titled "INTENT TO SOLE SOURCE: Preventative Maintenance and Repair Services," was posted on April 4, 2025, with a response deadline of April 11, 2025. It is a combined type solicitation under NAICS code 811310, managed by the Portsmouth Naval Shipyard Gf, part of the Department of Defense. The work is to be performed in Kittery, Maine. The point of contact for inquiries is Marilyn Fletcher, reachable via email or phone, and additional contract details can be accessed through the SAM.gov link provided.

Full Description

Under the authority of 10 USC 2304(c) and FAR 13.106-l(b)(l)(i), there is only one responsible source and no other supplies or services will satisfy the agency requirements. These preventative maintenance, and repair services can only be performed by the Original Equipment Manufacturer (OEM). The determination that the procurement for this service is a Sole Source requirement is based on the following excerpt from the Limited Source Justification form dated 12/09/24: "TRUMPF owns the software rights and requires a TRUMPF technician to perform the work and authenticate software. The TRUMPF laser cutter has capability that is not found in other equipment at PNSY, without this equipment x17 is either unable to perform work required or come up with inefficient alternatives that use up valuable material and unnecessary wasted man hours." Therefore, this requirement is to be solicited in accordance with Sole Source exclusive rights.
