This Background Information section is provided to outline the scope, expectations, and minimum requirements that will apply to all bidders submitting a proposal under this solicitation. The information contained herein is intended to ensure that all bidders have a clear understanding of the project objectives, performance standards, and compliance obligations. The City of Homestead owns and operates water treatment facilities and a water distribution system that serves City residents and businesses and certain Miami-Dade County customers. Following Hurricane Irma, an engineering assessment recommended that the City of Homestead's chlorine disinfectant system be replaced with new equipment that will be able to withstand the potential impacts of a major hurricane while increasing energy efficiency and effectiveness of the treatment process. A portion of the project includes a new pre-engineered, factory-built chlorine processing building to be reassembled on site. Bidders should review the Florida Department of Commerce Grant Agreement I0128, and amendments A1, A2, A3, paying close attention to the federal requirements associated with this grant involving compliance with Davis-Bacon Act and Section 3 Reporting (see Agreement I0128 pages 36-37 & 43-44). In addition, the below grant terms and conditions will be adhered to upon award and throughout the project: the period of performance or date of completion; the performance requirements; that the contractor is bound by the terms of this Agreement; that the contractor is bound by all applicable State and Federal laws, rules, and regulations; that the contractor shall hold Florida Department of Commerce and City of Homestead harmless against all claims of whatever nature arising out of the contractor's performance of work under this Agreement; the obligation of the City of Homestead to document in its Subrecipient reports the contractor's progress in performing its work under this Agreement; the requirements of 2 CFR Appendix II to Part 200 – Contract Provision for Non-Federal Entity Contract Under Federal Awards – (refer to Attachment L of Agreement I0128) the federal safety requirements applicable to the construction and installation of chlorine disinfection systems, including 29 CFR § 1910.119 (Process Safety Management of Highly Hazardous Chemicals), as applicable. the applicable requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, and its implementing regulations at 24 CFR Part 75. This includes the obligation to report labor hours worked, in accordance with 24 CFR § 75.25, and shall provide all information necessary for the City to meet its Section 3 reporting obligations to the State of Florida Department of Commerce and HUD. Pursuant to Attachment D of Grant I0128, the awarded contractor will timely submit completed forms for all prime and subcontractors as required by this Agreement, Florida Department of Commerce, HUD, and applicable, regulations and guidance laws, specifically including but not limited to: Certification Regarding Debarment, Suspension, and Other Responsibility Matters (Primary Covered Transactions); Section 3 Participation Report (Construction Prime Contractor); Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion (Subcontractor), (if applicable); and Section 3 Participation Report (Construction Subcontractor). Per the Environmental Protection Agency's (EPA) Risk Management Program (40 CFR 68), the contractor will be required to submit the Contractor Qualification Safety Forms with the submittal package.
