(a) Basis of Award.  This procurement is being conducted pursuant to FAR Part [13] procedures.  The Government intends to award a contract resulting from this solicitation to the responsible offeror whose [offer], conforming to the solicitation, [offers] the lowest price, whose [offered] price does not exceed the amount of funding available for the procurement, and whose [offered] price is found to be reasonable.  Price alone is the sole evaluation factor.  In addition to the general standards of responsibility found at FAR § 9.104-1, in accordance with FAR § 9.104-2, the special standards of responsibility described below apply to this procurement.  Offerors who fail to meet any special standard of responsibility will not be eligible to receive a contract award.    (b) Evaluation Process. Quotes will be evaluated in the following manner. The lowest-priced quote will be identified. The lowest-priced quote will be evaluated to determine if the quoted price exceeds the amount of funding available for the procurement. If the quoted price does not exceed the amount of funding available for the procurement, the quoted price will be evaluated to determine if it is reasonable. The Government intends to evaluate quotes and award a contract without discussions with offerors. However, the Government reserves the right to conduct discussions at any time if determined by the contracting officer to be in the Government s interest.     (c) Options.  The Government will evaluate [offers / quotes] for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an [offer] is unacceptable if the option prices are significantly unbalanced or if the [offered] price for the basic requirement or any option exceeds the amount of funding available for any of those requirements.  Evaluation of options should not oblige the Government to exercise the option(s).
(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before the award.    (End of provision)

Tulare Lake Basin Water Storage District-Kern County Water Agency Water Transfer Program. The Tulare Lake Basin Water Storage District and Kern County Water Agency have established a long-term water transfer arrangement that allows up to 66,000 acre-feet of State Water Project Table A Water to be annually transferred from Tulare Lake Basin Water Storage District to Kern County Water Agency, exclusively for the benefit of the J.G. Boswell Company, which operates farms within both agencies’ service areas. The original agreement, identified as SWP #23006, was initially set to expire on December 31, 2027, but has been extended through an amendment, SWP #23006-A, to continue through December 31, 2047. The transfer is a non-permanent arrangement, meaning the water rights remain with the Tulare Lake Basin Water Storage District and are only temporarily allocated. Environmental compliance under the California Environmental Quality Act (CEQA) is a condition of the transfer, having been satisfied through the completion of an Initial Study and Negative Declaration, which identified no significant environmental impacts and included necessary mitigation measures. While the contract specifies the volume, duration, and beneficiaries of the water transfer, it lacks detailed financial terms, pricing structures, line-item costs, or invoice procedures, indicating it is structured as a water rights allocation rather than a traditional procurement with monetary exchanges. Administrative oversight is managed through designated personnel from both the Tulare Lake Basin Water Storage District and the California Department of Water Resources, with no formal designation of contracting officer representatives or procurement officers. The performance location spans Tulare and Kern Counties in California, with the Kern County Water Agency in Corcoran serving as the administrative point of contact. No standardized Federal Acquisition Regulation clauses, socioeconomic certifications, unique entity identifiers, or contractual payment mechanisms are included in the documentation, reinforcing that this is a state-level water management agreement governed by CEQA and local water law rather than federal contracting standards.

It is exclusively set aside for 100% Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) under NAICS code 811310, with a small business size standard of $13 million in average annual receipts. The contract seeks quarterly ice machine maintenance services for 55 units across the Long Beach Veterans Affairs Healthcare System and associated outpatient clinics, requiring 220 annual service visits over a five-year period comprising one base year and four one-year option periods. Offerors must submit pricing using a firm fixed-price structure, with the award to be made on a lowest price technically acceptable basis, where price is the sole evaluation factor among technically qualified responders. All offerors must be certified SDVOSBs in the SBA database, actively registered in SAM.gov with a valid Unique Entity Identifier, and comply with strict subcontracting limitations requiring at least 50% of the contract value (excluding materials) to be performed by the prime contractor. Invoicing is exclusively mandated through the Tungsten Network, with electronic funds transfer required via SAM.gov, and all proposals must be submitted as a single PDF under 8.5 x 11 inch format, properly labeled, and emailed by the July 17, 2026 deadline. Failure to meet any mandatory certification, reporting, or compliance requirement renders an offeror ineligible. Deliverables include detailed quarterly maintenance reports with before/after photos, equipment identifiers, and service descriptions submitted in hard copy and digital form within five days of work completion. Contract performance will occur at multiple VA facilities in Long Beach and Placentia, California, with oversight conducted by designated government personnel, and any false representation of SDVOSB status triggers mandatory five-year debarment under federal statute.
