The Department of Veterans Affairs intends to award a sole source fixed-price purchase order to Eaton Corporation for the maintenance and battery replacement of two VA-owned Eaton uninterruptible power supply (UPS) units model 9390-100-160, located at the Employee Education System Broadcasting Studio in St. Louis, Missouri. This contract includes a Service Level Agreement (SLA) covering preventative maintenance and after-hour support for both new and existing UPS units. Eaton will provide delivery, installation, commissioning, and verification for 80 sealed VRLA batteries—40 for each UPS unit—due to the existing batteries reaching the end of their lifecycle. The total estimated contract value is $59,000. The sole source decision is based on Eaton being the original equipment manufacturer (OEM) for these UPS units and the only authorized provider of maintenance and support services, as confirmed by a formal letter from Eaton stating that they neither train nor certify third-party service providers, nor do they allow access to proprietary software or repair documentation. Market research confirmed no other vendors can legally or technically service these units, ensuring the protection of critical EES broadcasting operations that support Veterans Health Administration educational efforts. The procurement will be conducted under FAR Parts 12 and 13 using the Federal Supply Schedule contract GS-06F-0023R.

Furthermore, the letter states that Eaton does not train, certify or support independent third-party service providers to deliver or service its equipment. Additionally, no other service provider is authorized to possess Eaton proprietary (copyrighted) software, repair documentation, processes or materials. Without proper maintenance of the UPS system, EES broadcasting services would be vulnerable to any interruption of power or power outage, rendering the EES unable to continue operations that support the VHA s healthcare providers with an employee education platform for those serving our nation s Veterans.
