Notice of Intent to Sole Source


The Department of Veterans Affairs, Network Contracting Office 10 (NCO 10), intends to award a sole source contract to Becton, Dickinson and Company (BD), 1 Becton Drive, Franklin Lakes, NJ 07417, for a Priority Care Service Agreement for the BD LSRFortessa 4-Laser BRVUV Flow Cytometer located at the Louis Stokes Cleveland VA Medical Center, 10701 East Blvd, Cleveland, OH 44106.


The proposed contract is for a base period of one (1) year with four (4) one-year option periods, with a period of performance commencing on or about July 5, 2026. This acquisition is conducted in accordance with the Revolutionary FAR Overhaul (RFO) FAR Part 12, specifically FAR 12.102(a), governing acquisitions at or below the simplified acquisition threshold. The Government intends to solicit and negotiate with only one source based on the following justification: BD is the Original Equipment Manufacturer (OEM) and sole authorized provider of the Priority Care Service Agreement for this equipment. No other vendor is authorized to perform this service without voiding the manufacturer's warranty and certification of the instrument. Performance of maintenance by any other source would compromise the integrity of laboratory results used in direct patient care.


Interested parties who believe they can provide these services are invited to submit a capabilities statement to the Contracting Officer no later than May 28, 2026, at 4:30 PM Eastern Time. Responses must be submitted via email. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
