The Department of the Navy, Space and Naval Warfare Systems Command (SPAWAR) plans to modify its existing contract with Hewlett Packard Enterprise Services (HPES) under contract number N00039-10-D-0010 by increasing the contract ceiling by $1.2 billion, raising the total from $4.9 billion to $6.1 billion. This adjustment is necessary to accommodate the ongoing Continuity of Services Contract (CoSC) for the Navy and Marine Corps Intranet (NMCI) and includes options to extend CoSC services from May 1, 2014, to September 30, 2014. These options will only be exercised if the Next Generation Enterprise Network (NGEN) award and transition are delayed, ensuring uninterrupted service during the transition period. The decision to increase the ceiling comes as current requirements forecast exceeding the existing limit by September 2013. The modification is to be awarded under non-competitive conditions, justified by the unique position of HPES as the sole responsible source capable of meeting Department of the Navy requirements without service disruptions, given its control over critical infrastructure and software central to NMCI. The Navy has taken steps to encourage competition in the future NGEN contract by acquiring Government Purpose Rights to HPES's NMCI intellectual property and offering options to purchase hardware and infrastructure, facilitating knowledge transfer to potential new providers. The notice clarifies that this is not a request for competitive proposals, and the government holds discretion over competition decisions. Contact information for inquiries is provided, emphasizing transparency in communications about this contract action.

Full Description

The Department of the Navy, Space and Naval Warfare Systems Command (SPAWAR) intends to issue a contract modification to Hewlett Packard Enterprise Services (HPES) under contract N00039-10-D-0010 to increase the contract ceiling by $1.2B and include an option(s) to extend CoSC services from 1 May 2014 to 30 September 2014. Option(s) are being added to ensure complete transition to NGEN and will only be exercised if NGEN award and transition from CoSC to NGEN is delayed. The DON estimates that based on current requirements, the contract ceiling amount of $4.9B will be exceeded in September 2013. This contract action will increase the ceiling from $4.9B by $1.2B to a new ceiling amount of $6.1B. This notice of intent is not a request for competitive proposals or quotes. A determination by the Government not to compete based upon responses to this notice is solely within the discretion of the Government. Authority for other than full and open competition is 10 U.S.C. 2304(c)(1) and FAR 6.302-1, only one responsible source and no other suppliers or services will satisfy agency requirements. The incumbent provider, Hewlett Packard Enterprise Services (HPES) is the only responsible source able to satisfy DON requirements at this time. No alternative source can ensure continuity of service without major disruptions. HPES currently owns and/or controls most of the critical infrastructure and computer software used to provide NMCI services. The DON has actively worked to remove barriers to competition including purchasing Government Purpose Rights to HPES NMCI Intellectual Property and including options to buy HPES owned hardware and infrastructure. These steps have allowed prospective NGEN offerors to gain critical insight into the network architecture and operations which is promoting full and open competition for NGEN. Questions concerning this proposed ceiling increase may be directed to Kim Reavis at contact@example.gov or telephone +1 (555) 000-0000.
