Industry Day: A Government-Industry Exchange on Construction Contracting - An Invitation for Industry Partners to Collaborate with the United States Space Force Operational Contracting Enterprise
Solicitation # AFICC_KS_Industry_Day_September_2026
The United States Space Force Operational Contracting Enterprise is hosting an Industry Day on September 14, 2026, in Colorado Springs and via Microsoft Teams to collaborate with general contractors on accelerating construction timelines. The event focuses on the implementation of new, flexible contracting authorities, specifically Other Transaction Authority (OTA) under 10 U.S.C. section 2808a. This initiative aims to bypass traditional FAR-based procurement bottlenecks through Commercial Solutions Openings (CSOs), allowing the government to integrate commercial best practices and innovative building methods to move from concept to capability faster. Budget projections for FY27 through FY31 indicate significant opportunities, with approximately 5.6 billion dollars for MILCON and 3.3 billion dollars for FSRM projects. Under the 2808a authority, awards must be structured as Fixed-Price Other Transactions, such as Fixed-Price Incentive or Fixed-Price Award Fee agreements. Because these OTs lack standard FAR-based protections, the government and industry partners will develop tailored articles to govern disputes, changes, and terminations. The award process is phased, beginning with a white paper evaluation based on relevance and rough order of magnitude pricing, followed by an oral pitch of constructability plans, and concluding with the joint development of a Statement of Work. Evaluation criteria emphasize industrial construction methods, schedule realism, financial health, and adherence to commercial building codes like IBC and NEC, as well as DoD Unified Facilities Criteria. While flexible, these agreements still require compliance with the Davis-Bacon Act, Service Contract Act, Miller Act, and the Buy American Act.

NOTICE OF INTENT THIS IS FOR INFORMATIONAL PURPOSES ONLY. Under the authority of FAR 6.302-1, the 187th Fighter Wing (FW) Contracting Office intends to award a contract modification on a sole source basis, to Birmingham Industrial Construction, LLC for additional work on Building 1303. This sole source modification action is required for completion of the following scope of work: Work may include but will not be limited to any or all the following: Site work, installation of new concrete paving (on south side of building), installation of additional interior and exterior electrical services, installation of additional interior and exterior communications infrastructure and installation of security fencing and wall. The modification is required to support unanticipated equipment that is necessary for the basing of the F-35 aircraft. The sole source modification shall be made to Birmingham Industrial Construction, LLC the incumbent contractor who was awarded the initial competitively awarded contract for the renovation and repair of Building 1303. Reason for the sole source modification is the ongoing construction project makes awarding this project to a different contractor impractical due to coordination issues and access to the work site, blocked on three (sides) by ongoing construction projects and one (1) side by an active aircraft flightline. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. The Government is not obligated to and will not pay for any information received from potential sources as a result of this notice of intent. This Notice of Intent is hereby published in accordance with FAR 5.201. All responses received within 15 days of the posting of this notice will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The 187th Fighter Wing will consider any responses to this notice received within fifteen (15) calendar days of the posting of the notice. Responses may be submitted via email to contact@example.gov (include W50S6N23C0003 in the subject line of the email) or mail to 187th Fighter Wing/Base Contracting Office, Attn: Mr. Stephen Shanks, 5187 Selma Highway, Montgomery, Alabama 36108.
