The Department of the Treasury, IRS, Office of Treasury Procurement Services, intends to negotiate a Sole Source Firm-Fixed Price/Labor Hour Contract, for TRIP Claims Management Support Services, with Paragon Strategic Solutions Inc., under the authority of FAR 6.302-1. On November 26, 2002, the President signed into law the Terrorism Risk Insurance Act (TRIA) of 2002 (Pub. L. 107-297, 116 Stat. 2322). The Act's purposes, accomplished through the Terrorism Risk Insurance Program ("Program" or "TRIP"), are to address market disruption, ensure the continued widespread availability and affordability of commercial property and casualty insurance for terrorism risk, and to allow for a transition period for the private markets to stabilize and build capacity while preserving state insurance regulation and consumer protections. In the event of a certified act of terrorism, Treasury will receive claims from insurers requesting reimbursement under the Program, and recoup paid funds at a later date. This process must be administered through a tested and documented operating system (TRIP Claims System). The Department of the Treasury seeks to procure support for the Program and the TRIP Claims System through a TRIP Claims Management Contractor. The Contractor shall have the expertise in and knowledge of commercial claims insurance and reinsurance needed to develop a data system that supports the requirements of the Program. The Contractor shall use the requirements of the Act and implementing regulations, as well as all other federal statutes, rules, and procedures applicable to the creation and maintenance of such computer systems, in developing a tested and documented operating system that will be maintained in readiness throughout the period of the contract. Should a certified act of terrorism occur during the term of the contract triggering activation of the reimbursement conditions of the Program, the Contractor shall be able to estimate the scope of losses from such event, process requests from insurers/insurer groups for reimbursement of the Federal Share, reconcile payments authorized by Treasury, process the collection of any policy surcharges imposed to recoup some or all payments of the Federal Share of Compensation, and provide other statistical reports requested by Treasury. The Contractor shall be the main point of contact for operational questions from insurers regarding the Program. See the attached Performance Work Statement (PWS) for more details. Market research was conducted and it has been determined there is only one responsible source to provide these services. All interested sources must respond in writing with clear and convincing evidence to support their ability to provide the services identified in the attached PWS, by July 26, 2019 at 12:00 PM EST, via e-mail to the Contract Specialist at Tonya.Carr@irs.gov and the Contracting Officer at William.Stevens2@irs.gov. All contractors must be registered in the System for Award Management (SAM) database. THIS IS NOT A REQUEST FOR QUOTES OR PROPOSALS. The Government does not anticipate receiving responses to this notice of a non-competitive action. If parties choose to respond, any cost associated with preparation and submission of data or any other cost incurred in response to this announcement are the sole responsibility of the respondent and will not be reimbursed by the Government.
