The Florida Department of Law Enforcement (FDLE) has announced its decision to proceed with the negotiation and purchase of certain commodities and services under an exceptional procurement process, bypassing the standard competitive solicitation due to receiving fewer than two responsive responses. This approach is authorized by section 287.057(6) of the Florida Statutes, which permits such a process when competitive responses are insufficient, and is intended to secure the best terms and conditions for the State. The notice clarifies that this purchase is not related to the previously withdrawn solicitation for Textbook Publishing Services and Printing, Binding, and Distribution Services, and marks the final posting regarding that solicitation on the DMS Vendor Information Portal. Any parties adversely affected by this decision are entitled to file a protest within 72 hours of the notice, following the procedures outlined in Florida law, with failure to do so resulting in waiver of further proceedings. The contract involves a procurement effort with an estimated value ranging from $500,000 to $2,000,000, targeting vendors within the NAICS code 511130, which pertains to Book Publishers. The solicitation was posted on September 3, 2024, with a response deadline of September 6, 2024. The primary contact for questions is Angela Githens, reachable via email at [email hidden] or by phone at [phone hidden]. The procurement is managed by the Florida Department of Law Enforcement, which operates within the State Law Enforcement Division (SLED), and the project is to be performed within Florida. Interested vendors can access additional details through the Florida Vendor Marketplace online portal.

The Florida Department of Law Enforcement (FDLE) has determined that it is in the State’s best interest that the FDLE proceed to negotiate the purchase of these commodities and services on the best terms and conditions, pursuant to section 287.057(6), Florida Statutes, in lieu of re-soliciting competitive sealed replies. This is not a selection under FDLE-ITN-2502 Textbook Publishing Services and Printing, Binding, and Distribution Services, which is withdrawn by this notice. This is a notice of an exceptional purchase after receipt of less than two responsive replies, per section 287.057(6) Florida Statutes. This purchase is excepted by law from the requirements for competitive procurement. Pursuant to section 287.057 (6), Florida Statutes, this is the final posting by the FDLE on the DMS Vendor Information Portal regarding the FDLE-ITN-2502 Textbook Publishing Services and Printing, Binding, and Distribution Services. Any person adversely affected by this decision shall file a notice of protest in accordance with sections 120.57(3), Florida Statutes. Notice of protest shall be made as required by law within 72 hours of the posting of this decision. Questions to the Official Contact Person shall not constitute formal notice. Failure to timely file a protest or failure to file the required bond shall constitute a waiver of proceedings under Chapter 120, Florida Statutes.
