On-Call Right-of-Way Negotiator Services

Montgomery County, through the Montgomery County Transportation Authority, is soliciting qualified professional firms to provide on-call right-of-way acquisition and negotiation services for future road, bridge, and trail projects. The objective is to establish a list of qualified professionals with approved specialties and flat hourly rates to be utilized on an as-needed basis. The initial contract term is three years, with the possibility of two additional one-year extensions. Selected consultants will be responsible for managing right-of-way claims, conducting consultations on plat plans, handling property owner correspondence, preparing Form RW-299, and securing signatures for payment claims. All services must adhere to the PennDOT Right-of-Way Manual, the Uniform Act, and good faith negotiation procedures, and firms must be registered business partners with PennDOT. Proposals must be submitted electronically via the Bonfire portal, consisting of a technical proposal without pricing and a separate cost proposal. Evaluation is based on company profile, past performance on at least five similar projects, personnel qualifications, and a demonstrated understanding of transportation projects. The contract incorporates standard county terms and conditions, as well as a federal grant addendum for projects funded by federal awards, which mandates compliance with OMB Uniform Administrative Requirements and various civil rights laws. Required submissions include a current W-9, a public disclosure statement regarding financial dealings with county officials, and certifications regarding eligibility, independent price determination, and the absence of organizational conflicts of interest. Payment for grant-funded work is subject to the submission of undisputed invoices accompanied by detailed backup documentation and written progress reports.
