On-Call Right-of-Way (ROW) / Property Acquisition, Lot Line Adjustment, and Property Disposal Services

Ben Franklin Transit is seeking a qualified contractor to provide on-call right-of-way (ROW), property acquisition, lot line adjustment, and property disposal services under solicitation RFP 26-09, with a response deadline of June 5, 2026. The contract, governed by Washington State and federal jurisprudence and administered from Richland, WA, supports a range of transit infrastructure projects including the Huntington Training Facility, Southridge Transit Hub, Benton City Transit Hub, Prosser Transit Hub, and North Richland Vanpool Park-and-Ride Lot, as well as the disposal of the Downtown Pasco property at 1115 W Clark St. The scope explicitly excludes review of initial appraisals, which is reserved for a separate contractor. Contractors must be licensed appraisers and right-of-way agents in Washington, hold WSDOT approval, and adhere to the Uniform Standards of Professional Appraisal Practice (USPAP). They must also comply with FTA regulations under 49 CFR Part 18, Buy America requirements, Title VI, ADA, EEO, and the Privacy Act, with these obligations flowing down to all subcontracts financed with federal assistance. The contract is a unit price arrangement with a maximum estimated value of $600,000, and proposals must include fully loaded labor hour rates for all staff. Evaluation is weighted toward experience in public-sector ROW and land acquisition for transit projects (35%), understanding of BFT’s needs and processes (30%), cost proposal (20%), references (10%), and a signed cover letter (5%), with an optional interview possible for top scorers. Bidders must submit required certifications including debarment, nondisclosure, non-collusion (notarized), DBE participation, and lobbying forms, register with SAM within five days of award, and provide payment and performance bonds for 100% of the base award amount. Proposals must be submitted via the OpenGov e-Procurement Portal, with hard copies requiring a USB key; email and fax submissions are prohibited. Contracts are initially awarded for two years with an option to extend up to three additional years. Contractors are responsible for all taxes including Washington sales, use, utility, and B&O taxes, and must maintain records for at least three years post-contract. Invoices must be submitted on company letterhead to Accounts Payable and are due within 30 days, with finance charges applied at 6% APR for late payments
