Pharmacy Reverse Distribution Service

The Indian Health Service is conducting a sources sought notice for Pharmacy Reverse Distribution Services under the Buy Indian Act, 25 U.S.C. 47, to identify qualified Indian Small Business Economic Enterprises (ISBEEs) capable of performing this critical function. This is not a solicitation for bids or proposals, but rather a market research effort aimed at determining the availability of certified Indian Economic Enterprises (IEEs) that meet stringent eligibility criteria under 48 CFR 1480.201. To qualify, an entity must have no less than 51% ownership by Indians, Federally Recognized Indian Tribes, or Alaska Native Corporations, with management and daily operations controlled by Indian individuals, and must receive at least 51% of the earnings from the contract. Respondents must submit a detailed capability statement demonstrating specific, non-generic experience in providing reverse distribution services to healthcare facilities, along with the mandatory Buy Indian Act Indian Economic Enterprise Representation Form. The contract will be awarded to a single vendor capable of performing services at multiple locations across Montana, including facilities under the Blackfeet, Crow, Fort Belknap, Fort Peck, and Northern Cheyenne Service Units, with three on-site visits annually. The period of performance spans a base year from June 1, 2026, through May 31, 2027, with four one-year options extending through May 31, 2031. Contractors must be DEA-registered reverse distributors, compliant with the Controlled Substances Act, DEA regulations (21 CFR Parts 1300-1321), and IHS Manual Section 3-7.6C. Secure handling and segregation of controlled and non-controlled pharmaceuticals, reconciliation of DEA Form 222 documentation, and provision of certificates of receipt or disposition are required. Invoicing must be submitted electronically through the Invoicing Processing Platform (IPP), following FAR 52.212-4(g) requirements, and sent to the Contracting Officer’s Representative. All submissions must be received by June 8, 2026, at 3:00 PM MST. False representations regarding IEE status violate 18 U.S.C. 1001, and false claims during performance may trigger penalties under the False Claims Act (31 U.S.C. 3729–3731) and 18 U.S.C. 287.
