Pre-Employment Screening Program

The Pre-Employment Screening Program (PSP) is a Federal Motor Carrier Safety Administration (FMCSA) initiative mandated by Title 49 U.S.C. § 31150 to provide motor carriers, industry service providers, and operator-applicants with secure, timely access to driver safety and inspection data from the Motor Carrier Management Information System (MCMIS). Data release is strictly contingent upon verified written or electronically approved consent from the operator-applicant, ensuring compliance with privacy protections under the Privacy Act, the Driver Privacy Protection Act of 1994, and other relevant federal statutes. The contract requires the contractor to maintain a robust, secure IT infrastructure featuring encryption of data in transit and at rest, intrusion detection and prevention systems, a toll-free call center, and a responsive web interface compatible with current browsers and mobile devices. All personnel handling sensitive information must be U.S. citizens or lawfully admitted permanent residents, hold a high-risk clearance, complete favorable background investigations per DOT Order 1630.2C, and submit SF-85P forms within ten business days of employment. Non-disclosure agreements are mandatory, and all FMCSA data must be returned, erased, or destroyed upon contract termination or government request. The contract has a five-year base term, with options to extend for up to four additional one-year periods or two six-month increments, capping total performance at five years and six months. The contractor must deliver a fully operational system within 90 days of award and submit quarterly public newsletters, monthly internal updates, and improvement plans. Documentation including a Systems Security Plan, Configuration Management Plan, Incident Response Plan, Software Development Life Cycle Methodology, FIPS 199 Assessment, and Contingency Plan must be submitted and approved as compliance artifacts. Audit rights are extensive, allowing FMCSA or third-party assessors full access to facilities, personnel, and systems with as little as 72 hours’ notice for security-related inspections. The contractor is also responsible for auditing account holders and enforcing consent protocols, while ensuring all deliverables and working papers become U.S. Government property. Performance occurs at the contractor’s site, with a 90-day phase-in and phase-out period requiring weekly transition meetings for the first 60 days. The program operates at a Sensitive but Unclassified security level, and no government funding is allocated for service delivery—transaction fees are levied directly to third parties, with the government relying on the contractor to manage the system’s operations and
