Section 2.28 of the Solicitation Document enumerates FSDB’s Reserved Rights. Specifically, 2.28.3 reserves the right to reject all replies at any time, including after an award is made when doing so would be in the best interest of the State of Florida, and by doing so, assumes no liability to any Vendor. Section 2.28.4 reserves the right to withdraw the solicitation at any time, including after an award is made when doing so would be in the best interest of the State of Florida, and by doing so, assumes no liability to any Vendor. FSDB intends to pursue §287.057(6), F.S. that provides that if less than two responsive bids or proposals are received in response to a solicitation, the Agency may negotiate the best terms and conditions. Because there was only one vendor who attended the mandatory site visit, FSDB will be negotiating with HONEYWELL INTERNATIONAL. Because of this response, it has been determined that it is in the best interest of the State of Florida and FSDB to cancel all further activities of the subject solicitation and begin negotiations.
