This amendment to the solicitation and contract for reference lab services at the Battle Creek VA Medical Center and Western Community Based Outpatient Clinic implements Executive Order 14398, which addresses discrimination related to diversity, equity, and inclusion (DEI) in federal contracting. The key addition is the incorporation of the clause 52.222-90, which explicitly prohibits racially discriminatory DEI activities in recruitment, employment, contracting, program participation, and resource allocation. The contractor must provide information and allow access to records for compliance verification, report any subcontractor violations, and take remedial actions as directed. Noncompliance may result in contract termination, suspension, or ineligibility for future government contracts. This clause is critical since the contractor is also required to flow this provision down to all subcontractors performing work under the contract, except those operating outside the United States. Compliance with these requirements directly impacts government payment decisions and involves obligations such as reporting any lawsuits involving the clause’s validity. The solicitation, posted by the Department of Veterans Affairs, involves services categorized under NAICS code 621511, with a response deadline of May 15, 2026, and is managed by Contracting Officer Morgan Stein from the NETWORK Contract Office located in Dayton, Ohio. No other terms or conditions aside from this DEI-focused clause have been modified by this amendment.

General Info

Amendment adds DEI anti-discrimination clause 52.222-90 to contract, requiring compliance and reporting.

(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4). (c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.
