The Department of Housing Preservation and Development intends to enter into a Negotiated Acquisition contract with Nan McKay and Associates Inc. for the provision of rent reasonableness calculations. This procurement method was selected because previous competitive solicitations yielded only one respondent, and the agency requires a specialized vendor capable of complying with federal HUD regulations while providing a customized interface for bulk automated transactions. Due to internal staffing shortages and administrative backlogs, HPD has determined that a negotiated acquisition is necessary to ensure operational continuity and regulatory compliance.

Full Description

Pursuant to Section 3-04(b)(2)(i)(D) and 3-04(b)(2)(iii) of the Procurement Policy Board Rules, the Department of Housing Preservation and Development (HPD) intends to enter into a Negotiated Acquistion contract with Nan McKay and Associates Inc., located at 1810 Gillespie Way, Suite 202, El Cajon CA 92020.  This contract is for the provision to provide rent reasonableness calculations.  The contract term will be from 7/1/2024 - 6/30/2029 with options to renew for additional time.  The ePIN for this award is 80625N0008 and the proposed budget is $315,803.00.

HPD recently facilitated two prior solicitations using the competitive small purchase method for rent reasonableness on October 24, 2024, and February 19, 2025, in which only a single vendor- Nan McKay submitted a response. HPD requires a vendor that can comply with federal HUD regulations, provide a customized interface for managing rent reasonableness and allow the agency to automate and process bulk rent reasonableness transactions. HPD has thereby determined that a limited number of vendors are available and able to provide the work under these circumstances, and competition was determined inadequate. Additionally, the procurement process has experienced an unforeseen delay due to internal resource constraints, such as staffing shortages, and administrative processing backlogs within the agency.  Given this, along with the urgent need to maintain compliance and continuity of operations, HPD is requesting to procure these services through means of Negotiated Acquisition.

THIS NOTICE IS FOR INFORMATIONAL PURPOSES ONLY. Vendors can express interest in responding to a future procurement to provide these services by sending such request via email to contact@example.gov.

Compelling need for goods, services exists and cannot be timely met via competitive sealed bidding or competitive sealed proposals.
