Full Description
Pursuant to Va. Code § 2.2-1832 et seq.,the Division of Risk Management, (DRM) provides risk management plans for state agencies, local constitutional officers, and local governments. DRM receives the claim reports from plan participants and conducts an investigation. If suit arises under the Constitutional Officer and Regional Jail Risk Management Plan (VaRISK), the Virginia Liability Risk Management Plan (VaRISK 2), or the Commonwealth of Virginia Public Liability Risk Management Plan, DRM will assign counsel to handle the litigation as necessary.
Once DRM determines the need for a firm to represent a plan participant and assigns counsel, counsel will be responsible for all aspects of the case defense, including any and all appeals where DRM determines an appeal is warranted.
This SFP is issued pursuant to a determination by the Attorney General that there is no general statutory requirement for the Office of the Attorney General to provide representation in the case of suits against local governments or constitutional officers. Moreover, as agency counsel to DRM, which provides liability protection to local constitutional officers and local governments pursuant to VaRISK, VaRISK 2 and the Commonwealth of Virginia Public Liability Risk Management Plan, the Attorney General finds that it is impracticable or uneconomical for the Office of the Attorney General to render the legal services required in the matter in accordance with Va. Code §§ 2.2-507 and 2.2-510. Attorneys selected to do this work will carry the primary legal responsibility for defense of all cases, and DRM will provide case management.
