The contract involves the privatization of the wastewater collection utility system at Dover Air Force Base, Delaware, under the authority of 10 U.S.C. 2688. The government aims to transfer ownership of the utility system and establish a long-term, firm fixed-price service contract with a private entity. Initially, a competitive Request for Proposal was issued in November 2003, but the two submissions received were deemed unsatisfactory. Following Department of Defense guidance, the local utility provider, Kent County, was approached for a sole source negotiation due to their unique capability to meet the government’s requirements for operating the wastewater system. This non-competitive procurement is authorized under federal regulations that permit sole source contracting when only one responsible source exists. The procurement is identified by solicitation number FA4497-06-R-0007 and falls under NAICS code 221320, indicating electric power generation, transmission, and distribution utilities. The Department of Defense office managing the contract is located at Dover AFB, Delaware. This privatization effort signifies the government’s intent to streamline utility operations at the base by leveraging local expertise through a long-term contract, ensuring continuous wastewater services while transferring system ownership to the private sector. Questions about the sole source procurement are directed to Larry Pace, the designated contract specialist.

Full Description

Notice of intent to privatize the wastewater collection utility system at Dover AFB, Delaware pursuant to 10 U.S.C. 2688, as a sole source procurement with the local utility provider, Kent County. The Government's intent is to convey the utility system and award a long-term firm fixed price utility services contract. On 17 November 2003, a Request for Proposal, SP0600-04-R-0004, was issued as a competitive procurement to privatize this system. Two proposals were received but were deemed to be unacceptable. In accordance with Department of Defense Guidance for Privatizing Defense Utility Systems issued on 09 Oct 2002, the local utility provider, Kent County, was contacted to determine if they would be interested in entering into an agreement with the Air Force to privatize the wastewater collection system at Dover AFB, Delaware. As this procurement will now be a non-competitive action, this sole source negotiation will be accomplished under the authority of 10 U.S.C. 2304(1) and Federal Acquisition Regulation 6.302-1, which allows for the use of other than competitive source selection procedures when only on responsible source and no other supplies or services will satisfy agency requirements. Comments and questions regarding the sole source procurement may be directed to Larry Pace, Contract Specialist, at the following e-mail address: contact@example.gov.
