The New York State Department of Labor ("NYSDOL") is seeking to procure TCS Jile licenses pursuant to its discretionary purchasing authority under State Finance Law§163(6). This procurement opportunity is an SDVOB Set-Aside and is limited to businesses certified as New York State Service-Disabled Veteran Owned Businesses (SDVOB) pursuant to Article 3 of the New York State Veterans' Services Law. New York State Department of Labor is releasing this Request for Quote – Z-140 to seek bids from responsive and responsible vendors who are authorized resellers of TCS Jile licenses and can provide one hundred and twenty (120) TCS Jile (V 7.0 or later) Ultimate Edition concurrent licenses. TCS Jile is an enterprise agile planning and delivery tool. This will be an OP transaction (one-time purchase order). OP transactions do not require a formal contract document beyond the standard terms and conditions associated to a purchase order. The terms and conditions associated to a purchase order is attached to this NYS Contract Reporter Ad and titled “NYS PO Terms and Conditions”. NYSDOL anticipates awarding a single contract. Term The term shall commence upon applicable control agencies approval and shall be for a one (1) year period that spans 1/1/2027 – 12/31/2027. All applicable amendment information must be incorporated into the Bid. Failure to include this information in the Bid may result in the Bid being deemed non-responsive. All amendments, announcements, and clarifications related to this RFQ will be issued on NYS Contract Reporter web page: https://www.nyscr.ny.gov Response to Bidder Questions and Request for Clarifications Pursuant to State Finance Law § 139-j and § 139-k, this solicitation includes and imposes certain restrictions on communications between NYSDOL personnel and a prospective bidder during the procurement process. All questions/inquiries and/or clarifications concerning this solicitation shall be addressed to the NYSDOL designated contact(s) whose name appears under the “Contact Info” section of this NYS Contract Reporter Ad. Contacts made to other NYSDOL personnel regarding this procurement may disqualify the prospective bidder and affect future procurements with governmental entities in the State of New York. Responses to Bidder questions and requests for clarifications will also be posted on the NYS Contract Reporter website: https://www.nyscr.ny.gov Insurance Requirements Workers’ Compensation Law Compliance with requirement for workers’ compensation and disability benefits insurance coverage: After receipt of contract award letter, successful bidder must provide NYSDOL with proof of compliance with workers’ compensation and disability insurance coverage requirements set forth in Sections 57 and 220(8) of the Workers’ Compensation Law. To comply with the coverage provisions of Section 57 businesses must be legally exempt from obtaining workers’ compensation insurance coverage; or obtain such coverage from insurance carriers; or be self-insured or participate in an authorized group self-insurance plan. Successful bidder must provide one of the following forms to the Department: · C-105.2 Certificate of workers’ compensation insurance (business’ insurance carrier should be able to provide this form to NYSDOL) · SI-12 Certificate of workers’ compensation self-insurance or Form GSI-105.2 Certificate of Participation in Workers’ Compensation Group Self-Insurance (business contacts the Workers Compensation Board’s (WCB) self-insurance office at 518-402-0247) · GSI-105.2 Certificate of participation in workers’ compensation group self-insurance or Form U-26.3 issued by the State Insurance Fund (business’ group self-insurance administrator should be able to provide this form to NYSDOL). · CE-200 Certificate of Attestation of Exemption, which replaces Form WC/DB-100 for applicants seeking exemptions starting on Dec. 1, 2008 (available at: http://www.wcb.ny.gov To comply with the coverage provisions of Section 220(8) businesses may be legally exempt from obtaining disability insurance coverage; obtain such coverage from insurance carriers; or be self-insured. Successful bidder must provide one of the following forms to NYSDOL: · DB-120.1 Certificate of disability benefits insurance, or · DB-155 Certificate of disability benefits self-insurance (business contacts the WCB’s self-insurance office at 518-402-0247). · CE-200 (noted above). Contracts will not be forwarded to the successful bidder until they have provided NYSDOL with proof of compliance with workers’ compensation and disability insurance coverage requirements set forth above. ACORD forms are not acceptable proof of Workers’ Compensation and Disability Insurance.
